Capital Collateral Representation


Florida has three offices of Capital Collateral Regional Counsel (CCRC) which represent persons convicted and sentenced to death in collateral postconviction proceedings in their geographical jurisdictions. These include offices in Florida’s Northern, Middle, and Southern circuits. See, Jurisdictional Map of Florida’s three Capital Collateral Representation Regions.

When two CCRCs have a conflict of interest prohibiting representation, as required by s. 27.703, F.S., then the court may appoint private counsel from the Capital Collateral Attorney Registry. Pursuant to s. 27.710, F.S., the Justice Administrative Commission (JAC) maintains the Capital Collateral Attorney Registry, which is the statewide registry of attorneys in private practice who have certified that they meet the minimum requirements and who are available for appointment to represent persons convicted and sentenced to death in postconviction collateral proceedings. By law private attorneys may only be appointed from this Registry. Upon appointment to a capital collateral case, the attorney must notify JAC within 30 days of the appointment and execute the JAC Capital Collateral Contract per s. 27.710(4), F.S.
